MILLS M.P.J.R.133 has observed that Order 8 Rule 10 enables the court to adopt either of the two cources envisaged in the rule ,either to pronounce the judgment at once or to pass such order as it thinks fit .In the instant case since the defendant continuously defaulted in filing the written statement despite several opportunities granted to him, the discretion exercised by the court in pronouncing the judgment straightway cannot be said to be unjustified |
