TULSIRAM V/S STATE OF M.P. 1985 F.A.J.40 The rule9 [a] requires the local health authority, to send by registered post, copy of the report of the public analyst to the person from whom the sample was collected along with the the person who was named in information under section 14( a) The term "Immediately", as mentioned in rule 9 [a] conveys the term continuity and not urgency This means that copy of the report of the public analyst should be sent at the earliest opportunity so that the accused can exercise his right enumerated under section 13 [2] the non-compliance of rule 9 [a] is not fatal to the prosecution, however it depends on how much the accused was prejudiced
