RAJESH KUMAR V/S DHARAMVIR & OTHERS 1997 S C C (CRI)591 ALIBI= standard of proof -- must be proved with absolute certainty completely excluding the presence of the accused at the time and place where the incident took place.Defence witness claiming to be advocate for the accused in a pending case and stating that at the relevant time the accused was in his office -- no relevant document produced in support of his statement or prove the plea of alibi. The testimony of the defense witness does not substantiated the plea of alibi raised by the accused. |
