The accused charged and tried under section 302 --conviction under section 306 is illegal -section 306 of Indian panel code cannot be said to be a minor offence in relation to offence under section 302 within the meaning of section 222.  The two offences are of distinct and different categories.While the basic constituent of an offence under section 302 is homicidal death, the section 306 is suicidal death and abatement thereof .
