None of the injured persons have stated that they were assaulted with the intention of causing death.The injury certificate  disclosed that all the injuries of the injured persons were simple in nature except an injury to the petitioner, which was disclosed on their radiological examination.The intention is to be gathered from the substances of each case like motive, previous history, whether there was any enmity or any premeditation are the relevant circumstances .In a case where the injured persons themselves do not state that the assault on them was with an intention to cause death and the injuries suffered by them in general were found to be simple in nature, even if an injury resulted in fracture, it could not be taken that the intention of the assailants was to cause  death.
