the section is intended to give relief to up a person who is in unlawful detention for an unlawful purpose Bear reading of the section  makes it clear that before the powers under this section can be exercised the magistrate must be satisfied that there is unlawful  detention for unlawful Purpose.If either is not established the magistrate has no jurisdiction to pass an order under this section.to
